A Mexican court has prevented the recent decision by the electricity system operator CENACE to suspend performance tests for new wind and solar farms from entering into force, local media has reported.
A judge sided with several companies who filed for injunctions against CENACE, allowing them to continue with the tests necessary for the plants to start commercial operations, local reports state. The reports differ on whether there were six or seven companies that had been granted injunctions.
Mexico City daily La Jornada reported on Monday that the federal government could challenge the court’s ruling, but the appeals process would take months. In the meantime, the judge’s decision to stop CENACE's measure from entering into force prevails until all legal cases brought by the companies are resolved.
Last week, the judge, Rodrigo de la Peza, started issuing temporary stays to the plaintiffs and allowed cases to pile up as he decided whether or not to make injunctions definitive, La Jornada writes. According to La Razon, there were at least 27 requests for injunction from affected companies.
Faced with a flurry of legal challenges, CENACE responded last week it would respect the court decision, but would also use legal instruments to contest it.
